Medical documents are not incinerated with medical waste. They are either stored in a safe locked confidential file or they are disposed of through a professional confidential file disposal system, as our hospital has. Even if there is nothing more than a patient name, it goes into the confidential disposal.
For any professional, be it a lawyer, doctor, therapist, or whatever to so carelessly dispose of confidential documents is indefensible.
Thankfully the documents did wind up in “some revolting dumpster diver’s hands” and are not being read by garbage collectors or by anyone on the street who picked it up as it blew by.

I think I know how it works, from lurking on pre-abortion support boards. Rather, the abortion isn’t being discounted, but rather she still pays the same amount and private organizations have been set up to raise funds for women seeking abortions who may need a portion or the full amount for the abortion and she receives a loan or grant to pay for the difference she doesn’t have.

It is certainly your right not to but it really is helpful if you want anyone to understand exactly what you are referring to. My doctor has ‘cut me a deal’ when I have been without insurance or insurance wouldn’t cover ‘silly’ things like pap smears. I’m sure that he will be damned to hell for his compassion towards me.
It depends on he deal. If he was helping you with true medical care, I’d say he’s an okay guy. That does not include abortion though.

the question is why does it not apparently bother you that the abortion clinic was severing the tiny hands and feet and body parts of tiny human beings. at what point would you see the atrocity of dismembering a tiny human being. if the tiny feet and hands were of a 25 week fetus would that bother you. a 35 week old fetus. a full term baby. how do you rationalize this action in your mind. tiny feet and hands are not clusters of cells.

How else are you going to perform an abortion?
As someone pointed out a few weeks ago, in some ways we are all just a cluster of cells. I can understand the argument that abortion is bad, can you understand the argument that banning abortion is worse?
After viewing the above Hal, how can you argue illegal abortion was or would be any worse? The only difference I can see is that someone like Hodari can practice openly and legally.
Though I must admit his standards are considerably higher than the other Detroit abortionist who allowed his dog to walk around the operating area, a patient and her companion swore to this in signed affadavits, and admitted he referred to his patients as “dogs”. His wife, the “nurse” of the clinic, tended to patients in her tank top and short shorts.
Well, with illegal abortion this exception would be the rule. There would be no patient records, there would be no responsible disposal of remains, there would be fewer and fewer option for poor women. Families with money would continue to get their abortions quietly and safely in their doctors’ offices.
You do all realize that any of these materials that Dr. Monica Miller removed from the trash are not admissable as evidence?
I’m sure the police would have been more than happy to investigate this matter through a phone call, and clearly, if nothing else, this office has comitted HIPAA and Biohazard disposal laws and should be punished.
But since this woman took the law in to her own hands and self righteously decided to appoint herself an investigator, there is a strong possibility that this case will be thrown out when Dr. Hodari’s defense has clear proof (thanks to your blog, Jill), that all of the evidence in the case against him had been tampered with (even the things she didn’t take – if she opened the bags – thats tampering with evidence.
I am pro choice, but patient privacy and proper etiquette with ALL things medical are very important to me. It will be a shame to see a careless practice go unpunished because of some vigilante pro lifer.
The evidence won’t be automatically inadmissable. It is not uncommon for a private party to discover evidence before the policy arrive and mess it up a bit. As long as someone can testify it really is the evidence, and if she is believed, it would be sufficient to convict. But you are right, Amanda, they have handed the defense a gift since they can now argue that someone with an agenda against the doctor got to the evidence first and it should therefore all be suspect.

Reality check. Women with money continue to have their abortions done discreetly and quietly, travelling if necessary to do so. Do you think the CEO’s wife or daughter sits next to the welfare mother in the clinic waiting room?
The “exceptions” you talk about continue to be the rule with legal abortion. No responsible disposal of remains with illegal abortion? There would probably be much better disposal since an illegal abortionist would not want to get caught. Hodari had no such concerns. Legalizing something does not put the criminal or unethical element out of business. All to often it only gives them more opportunities.
Options for poor women? Hal, who do you think goes to these places like Hodari’s? Unsuspecting low and middle income women.
You’re right Hal, I should have been more clear, I don’t just mean that she came across it, but that she actually handled it, took some of it in to her posession, moved it (Jills earlier post said she brought the remains to a funeral home), photographed it, and released the information to the public before it was processed.
She’s not a cop – you can’t do that.
Cases have been thrown out without even going to trial for FAR less tampering than this.
When I lived in Brooklyn, I witnessed a bitter ex-boyfriend vandalize his ex’s car. I was called to the trial as a witness, but in the pre-trial hearings, the boyfriends defense brought up that the woman moved her car and removed the 2×4 he used to vandalize it before the police got there, and the entire case was thrown out for evidence tampering, despite the fact that I had witnessed the entire thing with my own eyes. WHOOOPS.

Good point, the police did in fact remove all kinds of material, both biohazard and medical files, from the dumpster. Unless Monica put on a biohazard suit and dove head first into the dumpster, I seriously doubt the evidence will be discounted. If you open a garbage bag and find a dead body or stumble upon a crime scene, I suppose you could call that tampering with evidence. However, the police can still use it as evidence. I believe they even permitted Monica to take some remains to a funeral home for burial.

People come across crime scenes including burglary, murder, and assault all the time. That’s how police find out about them in the first place. Evidence from these scenes will still be used or else very few cases would go to court.
Police do advise that evidence is left untouched and that they be immediately called. Of course this doesn’t always happen. Your friend did, however unknowingly, commit some serious violations of a crime scene and is why police advise they always be called first before anything is touched or moved.

We do not use paper shredders to dispose of confidential records. We have special bins and a professional disposal service for confidential records.
You might wonder how such records ever got into the hands of the people who dispose of the trash in Hodari’s office. Our non medical personnel, while having contact with patients, in no way handle or see their records and like the medical staff, would be immediately fired for looking at records they have no business looking at.

The difference between it being a violation of HIPAA vs. a crime is in what was done with the confidential materials. If they were disposed of improperly, thats just a warning or a fine depending on how many times its happened.
However, if the information was intentionally distributed, sold, or handed to someone who shouldn’t have seen it, that can actually be a crime.
In this case, it was just improper disposal.
He could still be sued by patients though- and I’m sure he will be, but so could Dr. Miller – photographing confidential paperwork is just as much of a violation.

Yeah, the hospital I work at is the same. I think most of the bigger institutions have switched over to the professional disposal management companies that use those special bins, but I know those services are pretty pricey. I think most small offices still use shredders – it puts a little more burden on the employees to be responsible though, which is when stuff like this happens.

I still have to wonder how these records got into the hands of the wrong people in the first place and what kind of shoddy practice would permit this. Why weren’t these records protected or professionally disposed of? What good are records in the first place if you just toss them in the dumpster? Definitely some very shoddy practice and lawsuit material.

It was Hodari’s clinic that put confidential patient records in a dumpster where anyone could have retrieved them. Its obvious he and his staff are the ones with little regard for patient confidentiality.

This “concern” about “patient confidentiality” is very ironic, in light of the anti-choice extremists who photograph every woman entering Planned Parenthood facilities and post their pictures on websites like “Christian Gallery” to invade their privacy, and encourage violence against them.

That method of intimidation/attempts at embarassment has had some flack from pro lifers as well, to be fair. Though I’m sure Jill is all for it, many of the other pro lifers who post on this blog are a little more reasonable about things like patient confidentiality. I’m not trying to be difficult, its just that I know I hate being lumped in to any assumptions about a movement as a whole, especially when discussing something thats sort of “fringe” and extreme, like Christian Gallery is.

While I in no way condone or support this kind of activity, looking at pictures of a bunch of people with no identities attached isn’t going to tell anyone much of anything, other than that people get some perverse satisfaction from doing this sort of thing. I can’t imagine too many people who have more productive things to do with their time want to sift through thousands of pictures on the remote possibility they may recognize someone, assuming they can even be certain that is someone they know.
Everytime you step into a grocery store, hotel, hospital, or any place of business your picture is being taken and can you be certain what happens to it, where it may end up? Its frightening the weirdos that are out there and what they’ll do.

You’ll get no argument from me, this is despicable. However this can be done to any of us, for any warped reason someone sees fit, which is indeed frightening. I’m also convinced the vast majority of people aren’t about to waste their time trying to identify a picture or license plate out of thousands.
I understand a well known set of conjoined twins complained of people taking their pictures in public like they’re circus monkeys. Besides this being a gross violation of privacy and incredibly disrespectful, there would also be the concern as to where these pictures end up or how they may be used.

In fact, all medical treatment is not elective and yes you can force treatment.
I’ve treated more than a few suicide attempts against their will. When I worked ER, once a suicide attempt was made all rights were lost. The person either agreed to treatment or would be restrained and treated.
Also, emergency surgery is not elective. If one is brought to an ER from an accident or any other emergent situation, they will be cared for whether they can grant permission or not.

Life Site News reports that 15-year-old Tamiia Russell died January 8, 2004 after a second trimester abortion at Woman Care Clinic in Lanthrup Village, near Detroit. Womancare is a member of the National Abortion Federation.
According to U.S. Newswire, Tamia’s abortion had taken place January 7.
Dr. Leigh Hlavaty, who performed the autopsy on Tamia, told a local pro-life activist who contacted LifeSiteNews.com that the girl’s death was caused by “uterine infarction with sepsis due to status second trimester abortion.” Hlavaty said, “I ruled it normal because these complications are expected with this type of abortion.”
Tamiia’s “boyfriend” was 24. In Michigan that constitutes statutory rape. The man’s sister took Tamia in for the abortion behind her parents’ back, in violation of Michigan’s parental involvement law.
Tamiia’s family told Fox News that they did not even know their daughter was six months pregnant. U.S. Newswire cites Fox, saying the family had only learned of the pregnancy the day before the abortion. The family is blaming the abortionist for Tamia?s death. According to Jews for Life, the abortionist was Alberto Hodari. Appallingly, the Michigan medical board has no disciplinary actions listed against Hodari despite his appalling track record.
According to Tamiia’s mother, laminaria was inserted WomanCare on January 7, then Tamiia returned home. She told her aunt and mother that she was pregnant and she had begun the abortion. Tamiia’s mother said that she called the clinic, and staff told her that the abortion once be carried out once the laminaria are inserted. Life News notes, however, that according to eMedicine Journal, “pregnancies have safely been carried to term after laminaria insertion and removal.”
According to Life News, Tamia bled heavily after coming home froom the abortion on January 8. She bled so heavily that the blood soaked a mattress. She was dead on arrival at the hospital despite paramedics’ attempts to save her. Jews for Life reports that she died of sepsis.
According to Tamia’s cousin, Nicole Redden, the sister of Tamia’s abuser took her to five different Detroit area abortion facilities, and was turned away from all five because of how far advanced Tamia’s pregnancy was. One facility reportedly even offered prenatal care and vitamins.
Hodari was also implicated in the death of Chivon Williams Dr. Miller, director of Citizens for a Pro-life Society, reports that there have been 23 lawsuits in the past 20 years against WomanCare facilities and Alberto Hodari, for abortion injuries including complications resuting on hysterectomies on 19, 22, and 23-year-old women. All were dismissed, with many referring to undisclosed settlements.

Oakland County Assistant Prosecuting Attorney Jim Halushka told LifeNews.com that his office has reviewed an initial investigation by police into the abortion. If the abortion facility knew that Russell was under 18, they could be charged with a misdemeanor for performing an abortion on a minor.
