Responding to a question on Obamacare during an April 2 press conference, President Obama admonished the U.S. Supreme Court not to take the “unprecedented and extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress”…

Legal experts and politicos are tearing Obama’s statement up as obtuse, particularly since Obama prides himself as having been a “constitutional law professor” (although that title is disputed), and also false, since 219-212 is no “strong majority,” particularly since the former were all Democrats.

But I’d like to hearken back to the Partial Birth Abortion Ban Act of 2003, a federal law that actually does qualify as having been passed by a “strong majority of a democratically elected Congress.”

Before the Supreme Court had even heard the case, Obama deemed the PBA Ban “clearly unconstitutional” in a 2004 fundraising appeal signed by surrogate Michelle, “that must be overturned.”

When the Supremes upheld the ban, by as narrow a vote as is anticipated in the Obamacare decision, Obama protested. When speaking at a Planned Parenthood fundraiser in 2007 he said:

For the first time in Gonzales vs. Carhart, the Supreme Court held – upheld a federal ban on abortions with criminal penalties for doctors. For the first time, the Court’s endorsed an abortion restriction without an exception for women’s health. The decision presumed that the health of women is best protected by the Court – not by doctors and not by the woman herself. That presumption is wrong.

In that case Obama was condemning the Supreme Court for upholding a federal law, which was actually a healthcare law of sorts, since it sought to protect half-born children from being stabbed to death.

In a statement on the 35th anniversary of Roe v. Wade in 2008, Obama again condemned the Court for upholding this broadly passed federal law (which was also broadly supported by the American public, which Obamacare is not):

Last year, the Supreme Court decided by a vote of 5-4 to uphold the Federal Abortion Ban, and in doing so undermined an important principle of Roe v. Wade: that we must always protect women’s health.

And about Roe v. Wade, Obama didn’t mind the titanic upheaval of legal precedent when the Supreme Court overturned abortion laws in all 50 states in its 1973 decision. At the time abortion was illegal in 30 states and legal only in certain cases in 20.

Don’t forget Obama also anticipated Illinois’ Born Alive Infants Protection Act would be declared unconstitutional (pgs 84-90) because…

I mean, it – it would essentially bar abortions, because the equal protection clause does not allow somebody to kill a child, and if this is a child, then this would be an antiabortion statute. For that purpose, I think it would probably be found unconstitutional.

Barack Obama is so tangled up internally he can no longer keep himself straight externally.

  1. I doubt it. But the worshipful homage of voting rubes presages the credulity attested regarding the AntiX. 

    I just don’t see a need of using the definite article in saying what you’re saying. There are enough AntiXs to go around without worrying about whether a particular one is “the”.

    Obama is acting like a man who is lobbying for one of the judges to change his vote!

  3. Yeah, his use of “strong majority” annoyed the heck out of me. If it was such a “strong majority”, why did it take so many votes for it to pass? And the last vote was only won when Obama made a back-door deal with the supposed “pro-life” democrat hold-outs.

    Also:

    Otherwise, excellent post. I feel sorry for Obama: he’s trying to both stick to his principles and do good (giving him the benefit of the doubt), but he’s in denial of the great contradictions that result. He’s a smart guy, so deep down he must realize his own inconsistencies. But he’s painted himself into a corner with his voters and donors.

  5. Hey Michelle, don’t you think you’re begging the question a little bit by calling it a legitimate medical procedure? I mean, didn’t congress decide it was not and the Supreme Court said it was their right to do that. Unless your definition of legitimate medical procedure is something stupid like its performed by doctors, so it must be legitimate.

    Courtnay,  technically the antix was Emperor Nero, who’s name could be converted into the beast’s number.  Around the first couple centuries AD it was a popular folk thing to convert people’s names into numbers.  I took a class on Revelation and heard this for the first time.  I was so incredulous, I attended another seminar with a different lecturer.  Same story.  I was stunned.  I stayed after and asked the professor, “Really?  It was Nero?  Did everyone know that?”  “Well, they knew it during John’s lifetime..”  “So, in other words, the anti christ has been and gone?”  “Yep.”  

    Besides, I wouldn’t give Barry O that much notoriety.  He’s too small and petty to deserve it.  I hope he ends up a tiny footnote in history.   Also, let’s not forget:  Obama didn’t win his party’s nomination by a landslide, no, but by a slim margin.  Hilary had nearly as many votes as he did.   He seems to be lacking in basic math skills.

    pp kills black children at a much higher rate than any other ethnicity.

    pp targets blacks by selecting their communities in which to place their  abortuaries.

    Nearly all the black children who enter pp’s killing centers do not exit alive.

    Maybe thats what mr. bo-jangles was suggesting when said his son would look like Trayvon Martin: they would both be dead.

  9. Would someone please explain to me what’s so problematic about criminal penalties for doctors? Is he suggesting doctors are some special class of people whose actions are always right? Wonder how Obama feels about the whole Kermit Gosnell mess.

  10. Obama’s attempt to strong-arm the Supreme Court sounds both desperate and frightening. In the 2010 State of the Union he scolded them to their faces. Now he tries to tell them not to overturn a law. This is only their job  –  the reason they exist.
     
    He has no sense of decorum. He acts like a Community Organizer-In-Chief. A street thug protester. He truly is the least presidential president in our lifetimes.

    I recently listened to the speeches Obama and Hillary Clinton gave to Planned Parenthood, along with some of their old annual reports.  It’s curious that they almost never actually use the term “partial-birth abortion”, instead using vague (and arguably misleading) language like “federal abortion ban”.  In 2004, they seemed quite proud of being nation’s biggest abortion chain.  Now, they barely even use the word “abortion”.  This goes to show that they’ve lost ground that they’ll probably never get back.

  12. I said when he was running for POTUS in 08 that “if he’s elected Chicago Way thug-style politics will go national” and it has. I know Jill did everything she could to expose his real pro-death agenda.  I understand his campaign website took down a video of actress Katiana Ali(sp?) ex Fresh Prince Of Bel-Aire star saying “during his first term he couldn’t do what her really wanted but when President Obama gets re-elected then it will be on!”. You want to guess prolifers what that means for the unborn? He already has an open-door policy for meetings with PP’s Celeste Richards anytime she wants, the Obamacare Dead Babies R Us financial pipeline set to push funds straight into PP and death panels are being set up to give either a thumb up or thumb down for elderly and disabled persons.

    True. And black women, who constitute 6% of the population have nearly 36% of the abortions.  This for Barack Obama is his idea of women’s health care that he is passionate about and will go to the mat to defend.   He is thus wholly invested in the genocide of his own people.
