food.jpgI said I would relay contents of the investigative report by the New Jersey Dept. of Health and Senior Services re: the Alternatives abortion mill in Atlantic City, which I have just received in the mail.
NJHD closed the mill June 22 for multiple violations. The AP reported July 24 it remained closed, “as it again failed to submit a plan on how it would fix the violations.”
It’s no wonder. There are so many. The investigative report is 105 pages. Due to the volume of violations, I will today spotlight 20 from only the first 30 pages, by no means a comprehensive listing. These are lifted directly from the report….

  • The soiled utility room… is equipped with a garbage disposal. Staff member #6 stated the garbage disposal was used for the “disposal of tissue”….
  • The recovery room, with the lack of privacy curtains at each recovery station does not provide patient privacy and dignity…. [R]ecovery beds are not visible from a nurses station…
  • The facility has no nurses station….
  • The patient recovery lounge is not supervised… and does not have convenient access to toilet facilities as required…. Patients must cross the post anesthesia recovery room or the waiting room to access a toilet….
  • The facility has no… locked storage for biologicals…. Currently drugs are stored in a closet within the sterile corridor.
  • Staff #2 and 4 stated that Staff #5 brought his/her own drugs into the facility to administer during procedure. There was no evidence of a policy that addressed physicians bringing their own supply of medications to the facility.
  • The facility is not equipped with a covered entrance for the pick up of patients as required….
  • The facilities waiting room does not have… public telephone and a water fountain as required….
  • The facility has no interview space for private interviews with patients as required….
  • The… counseling room is now being used as a patient changing room.
  • There was no physical evidence or documentation… to verify that the existing heating and ventilation system meets… requirements…. [N]o… evidence of positive pressure within the operating rooms…. [N]o…
    verif[ication] that each operating room has a minimum of 15 air changes per hour, of which 3 are with outside air as required….
  • The bathrooms were not equipped with mechanical or natural ventilation.

  • The third floor office common corridor was blocked with the facilitiy’s supplies, impeding egress to the rear fire exit….
  • The administrator shall have a baccalaureate degree and two years of full-time, or full-time equivalent…. Employee #s 2 and 4 stated that employee #1 asked them to be the administrator and co-administrator since March 2007…. Prior to [that]… they were the “Lab Technican” and “Ultrasound Technician” for the facility, and continue to serve in these roles as needed.
  • The administrator shall be responsible for… ensuring the development… and enforcement of all policies… including patient rights…. Based on review of 10 of 10 patient records where surgical procedures were performed… it was determined that the administrators are not aware of… these policies… 5 out of 5 employees… interviewed did not know that these policies existed….
  • 7 out of 7 employee files reviewed for compliance with State Licensure requirements… did not contain evidence of training, competencies and job descriptions.
  • [T]he facility failed to ensure that physical examinations were performed…. The “Preoperative Physical Examination” form in 5 out of 10 medical records where surgical procedures were performed… were blank and not signed by the physician…. 3 out of 10… were blank except for temperature, pulse and blood pressure and were not signed by the physician.
  • 7 of 13 medical records reviewed for Ultrasonography reports… indicated… the patients were past 16 weeks… pregnant.

  • According to employee #s 2 and 4, th facility “only has one registered nurse who works on Thursdays and Saturdays.”… [T]he facility was in operation Friday June 8, Sunday June 10, Friday June 15, Monday June 18, Friday June 22 and Monday June 25 without providing nursing services…. There was no documentation of the assessment of nursing care needs in 10 out [of] 10 medical records reviewed…. There were no clinical notes by nursing personnel in 5 out of 10 medical records where surgical procedures were performed.
  • A review of the Minor Complications Log for 2006 and 2007, indicated that there were 37 minor complications recorded. A review of the Major Complications Log for 2006 and 2007 indicated that there were 5 major complications recorded for 2006 and one of which was recorded as a “perforation.”
