Can a mother be charged with attempted illegal abortion after getting a legal abortion?
The Fulton Daily News reported yesterday:
Katrina L. Pierce, 24, of… West Monroe [NY], was arrested by officers with the Oswego County Sheriff’s Department at 1:20 p.m., April 9 and charged with second-degree self abortion, a class-B misdemeanor, after she reportedly attempted to kill her unborn 13 week old baby by ingesting several over-the-counter and prescription medications, an act that took place April 4. Released on an appearance ticket, she is scheduled to answer the charge before West Monroe Town Court April 19.
At this point the various moral dilemmas for pro-aborts are complex enough. (For instance, were any of those OTC meds emergency contraception? Think about it.)
But today, we add this to this mix, from Syracuse.com:
Oswego County Sheriff Reuel Todd has declined to say whether Katrina L. Pierce is still pregnant.
So if Pierce gets a legal abortion before her court date April 19, can charges still be pressed? There won’t be any evidence.

I wonder if it was situations like these that Sandra Day O’Connor had in mind when she wrote that Roe v. Wade was “on a collision course with itself.”
Well if it was an incomplete abortion, or had any type of complications, isn’t it possible a legal abortion was sought to correct the problem? Women can die from incomplete abortion. Therefore, it could be possible that the legal abortion was a life-saving measure. Just speaking hypothetically here, as we don’t know all the facts of this case – but I wonder if that would change the legal argument of the case.
I wonder why she did not seek a legal abortion in the first place. Perhaps the cost? This story doesn’t make it harder for me to be pro-choice. I feel very sorry for the woman and wish she’d had better information and care.
From what I’ve seen and heard about these abortion clinics lately, her standard of care and cleanliness was probably higher than a clinics.
Am I the only one who thinks it’s an outrage that self-abortion is illegal at all?

Momof3, I would recommend misoprostol early in pregnancy for self-abortion. Alternatively, methotrexate, or virtually any other conventional chemtheraputic agent, in a dose five times lower than the conventional chemotheraputic dose. With the methotrexate, you’d have to be prepared to miscarry at any time though. And of course there’s the problem of obtaining the drugs without a doctor to write a prescription, which is a separate crime in itself.
But that’s beside the point, which is, that government should not be attempting to police self-abortions. That’s an unjustifiable intrusion into the patient’s personal life.

I can see this one from both sides, SOMG. On the one hand, I can agree: it is intrusive. On the other, abortion can be dangerous for the female involved.
I tend to lean in agreement with you, SOMG. I know that if I was put in that position, I’d much prefer to do a herbal abortion at home, and if that didn’t work, I’d go to a clinic.

Jill, I’d really really prefer women go to clinics, I really would. Messing around with home abortions is a dangerous passtime, and herbal abortions don’t always work. I’m certainly not advocating back ally abortions, no way.

“What if she dropped dead?” That’s very unlikely. But the thing about self-medicating is, you are responsible for any problems you have because of it. You can’t blame the doctor if there is no doctor involved. You choose to take your own risks. There’s no reason to having the government punish you for doing so. The risks involved are punishment enough.
Jill, I don’t think I saw anyone saying they wanted back ally abortions legal…but there are certainly ways that abortions can be done with herbs and such, and that the government shouldn’t be able to police it.

I once read about a women who took some type of herbal medications, then spent some time reflecting and visualizing the walls of her uterus shredding. After some time, I believe it was about a week, she had a miscarriage. Should she be charged with attempted murder too?

But say the first patient isn’t a patient. What is it? It comes from the woman and it is cut into. Either its one of her organs or tumors or a parasite, or it is a baby. You can’t have it both ways. SOMETHING from inside the woman is cut into.

momof3, please understand that I am not trying to be rude or disrespectful to you, and I’m not trying to single you out, there are many posts that are similar to yours, it’s just it was your post that popped out to me the most, I actually found it judges well on your character that you showed a slight compassion for this “self-administer”, unless of course you were being sarcastic, it’s difficult to tell with words written down, rather than vocalization.
Now, this is just me assuming things, but if abortion were to be illegal in every state, as in; there was absolutely no where in the world to get an abortion, don’t you think things like this would happen more often, you know; “desperate times call for desperate measures”. Most of these posts spoke of these “back-alley” abortions and how entirely dangerous they are, some of you even mentioned how they are dangerous, so why not keep abortion llegal as a way of making it safe?
Any thoughts?

I’ve only in the past 2 months have started reading the articles and posts on this website, so maybe I have no grounds for talking, but I see you posting on here a lot, so obviously you read most, if not all of the articles… so maybe the only reason why you have only seen and heard about un-cleanly abortion clinics, is because the only time you have heard about them is here on http://www.jillstanek.com, obviously, she would never write an article about an abortion clinic that is safe and clean. Now, don’t take this as me saying there are no un-cleanly and un-safe abortion clinics, because even being pro-choice, I realize there are, but you have to take into consideration, there are many that are both as clean and as safe as they can possibly be.
Again, any thoughts?
So instead of passing laws to make abortions illegal, because eiether way, someone will find a way to do it themselves, Jill’s article was a perfect example, why don’t we pass laws to at least make abortion clinics have to live up to certain standards regarding cleanliness and safety, and maybe only until up until a certain point, for example, 12 weeks, how most abortion clinics are, well before the fetus can actually substain life outside the womb?
Also, I have posted on this website before, and I was called out, and Jill deleted my post for supposingly “insulting” and individual and being “rude”, as how she has deleted many of the pro-choicers posts on this website, for a variety of ridiculous reasons. However, in my case I simply asked an indiviual to please reply to my posts without a verse from the bible, or in reference to religion, and MK, I believe it was you who called me out in the first place, so I find your following comment ironic…

Don’t feel bad. Just cuz my students were only 4 years old, I still taught them.
That was always a problem. Preschool teachers don’t get the same respect as other teachers. But I can tell you we work just as hard. My kids were mostly immigrant children. It was like a little UN. Nobody spoke English, but nobody spoke each others language either. Lots of gesticulating!
They were from India, Peru, Poland, Syria, Africa,
Israel, Iran, Italy, and every once in a while one was born here in the good ole’ USA.
I loved it. I miss it. But now I watch my granddaughter and soon to be second grandchild…

Call me crazy but i’d like to teach middle school math. Although at this point i’d take anything offered to me. I live in Minnesota, where teaching jobs are competitive. You could have over 200 people applying for one job.

Shouldn’t we call it what it is, “Maternal Infanticide or, Maternal Zygoticide, or Maternal Feticide or just plain Maternicide (or would that be killing your mother or, would that be a zygote killing his mother).” Can’t we all agree on something.

You know from reading all of the brilliant posts over the last few weeks, I’ve got a potential solution to the whole abortion snenario:
1) Woman gets pregnant through no fault of her own (that admission will satify Alyssa, Rae, Less, Amanda, Danielle and SamanthaT).
2) Immediately she goes to a womb to womb transfer clinic run by Planned Parenthood where the zygote is transferred from a real womb to a mechanical womb. Mother signs a waiver of rights with regards to the child and a confidentiality agreement (Lando would like that one). Ex-mother is now paid $300 by Planned Parenthood instead of having to pay PP. (PP is now supported by pro-lifer donations who just can’t think of letting any baby die…Hisman, Jill, MK, Valerie, and MomOf3 would like that).
3) Zygote turns into a baby. (Hisman, Jill, MK, Valerie, and MomOf3 would like that one too).
4) Baby is born (that too).
5) Baby gets adopted by Planned Parenthood who train baby to be a Mechanical Womb Counselor using same brain washing tactics they used to come up with the term, “pro-choice”.
Everyone’s happy: Mom got rid of baby. PP eventually got their $300.00 and a lot, lot more. Pro-lifers saved a baby’s life. The government doesn’t have to worry about employment figures. What do you think? Do you think that all these Mecahnical Womb Counselors would form a Union? Hey Dems, are you listening? It’s a win, win, win situation.
Why do pro-deathers have such trouble with conceptual thought and its correct expression based on lingual convention? Why do any of us let them get awy with it?

HIsMan, don’t try to understand “pro-choice” it’s really complicated. Basically, a woman has the right to choose whether to have an abortion or not. The government can’t force her to remain pregnant if she doesn’t want to be. You can try to talk her out of it, but you can’t make it illegal.

Bethany, it wouldn’t be “settled” even if we had such a vote. Pro-life poeple would not change their opinions if abortion was voted legal, and abortions would continue if the vote went the other way.
I was just pointing out that it seems to me that most Americans are not too concerned with the status quo. From a small slice of the population that visits Jill’s blog, it is easy to forget the larger picture. There is no crisis, the sky is not falling, all is well with the world.
Doug, it’s a common ploy to try to dismiss the enemy, which is what we are, face it. In reality, the battle over abortion only grows more fervent as time goes on. And all is, of course, not well with the world when we kill over 1 million babies a year in the US via abortion.
