For the first time in five years, the Center for Bio-Ethical Reform Midwest was able to exhibit graphic signs showing the truth about abortion in downtown Dayton, OH, during lunchtime on August 3.
CBR was only able to exercise this First Amendment educational freedom following a unanimous decision by the 6th Circuit U.S. Court of Appeals that a police stoppage of a similar CBR demonstration in 2002 was unconstitutional.
The August 3 CBR event two two-pronged. While organizers staffed a display of huge photos comparing abortion to genocide at the Montgomery County Courthouse from 11a to 2p, CBR’s billboard trucks with photos of same circled downtown.
In a related shocking free speech exercise, the local media, the Dayton Daily News, videotaped the event showing both sides of the debate – including the graphic photos – with no commentary, making it available to readers online with the caption: “Abortion: Right or Wrong? You decide”

Biased I may be, but the Planned Parenthood hack who backed away from the “pro-abortion” label in the video looked defensive and only substantiated that there is something bad about abortion.

I’ve seen these trucks around Kansas City. I first saw them a couple years ago, and I recently saw one a week or so ago.
I saw these pictures displayed @ the DC March for life. You should have seen the looks on people’s faces. I saw a few crying. It doesn’t make sense. If a doctor/nurse worked in the NICU, they must handle these preemies with the ultimate gentle care. An abortionist can take that same age child, stab him in the skull, suck his brains out, and toss him in the garbage. That’s insanity!

Why shouldn’t children carry signs for NOW and NARAL? Gee, when over a MILLION marchers showed up for the March for Women’s Lives the kids seemed to be having a field day.
I think making kids carry pictures of mangled fetuses or Christ being torture-murdered is really sick, yet I see it all the time.

By the way, OB/GYNs are the most sued specialists when it comes to malpractice. They’ve almost been sued out of existence in Texas. Using your standard, shouldn’t we assume that all OB/GYNs are “raggedy” and shut them all down?

Yet since the 1980s, the number of lawsuits and claims against ob-gyns has been greatly disproportionate to their numbers in the medical profession. An August 1999 report by the Risk Management Foundation of the Harvard Medical Institutions found that although ob-gyns made up only 5% of physicians covered under their insurance plan, they generated 14% of all claims and accounted for 23% of the plan’s losses.
“Any time a parent doesn’t have a perfect child, they want compensation,” says Michelle A. Bourque, JD, a New Orleans-based defense lawyer with the American Bar Association. The heavy emotional impact of damage to a woman’s reproductive capabilities, as in Linda’s case, also increases the likelihood that a woman will sue. ACOG’s survey, to which 1,428 ob-gyns responded, showed that 76.5% had been sued at least once in their careers, up from 73% in 1996. And most ob-gyns are sued more than once. “Ob-gyns can expect an average of 2.53 medical malpractice lawsuits to be filed against them during their careers,” says the ACOG survey, released in January, a figure that has also risen since 1996, up from 2.31.
“It’s widely acknowledged that ob-gyns, along with neurosurgeons and orthopedic surgeons, are sued more frequently because of their high-risk clientele,” says Bourque. “Ob-gyns are especially susceptible because of the intense emotional significance of birth.”
The Doctors’ Nightmare
In addition to being sued more frequently, ob-gyns pay the highest claims. In a 1998 report summarizing 13 years of data, the Physician Insurers Association of America, a Rockville, Md., trade association, found that 26% of claims resulted in judgments of $250,000 or more. Such high payouts inevitably drive up the cost of medical malpractice insurance. The national average for ob-gyns’ annual premiums, according to Strunk, is $30,000, although in some areas it can reach a staggering $140,000. In comparison, premiums for internal medicine physicians can range from $3,782 in Arkansas to $28,548 in New York’s Nassau and Suffolk counties, according to the monthly newsletter Medical Liability Monitor.
Ob-gyns first began leaving their profession in significant numbers in the 70s and 80s, when liability insurance became either unavailable or unaffordable. Today, the pressures on doctors who perform obstetrical care are somewhat different. Decreasing reimbursements from HMOs, added to high malpractice premiums, have raised the cost of providing care so high that many doctors feel they can no longer afford to practice.
“We’re in a crisis situation,” says Susan Wilson, MD, a San Francisco ob-gyn, who recently restricted her practice to gynecology. “HMO reimbursements are so low that they don’t cover the cost of providing care. Sometimes what the insurance provider will pay for a treatment, like a shot of Rhogam, doesn’t cover the cost of the drug and the equipment. So what do you do? Do you pay for it yourself? Do you not provide the care?”
Other doctors feel they pay as high a cost psychologically as monetarily for delivering high-risk obstetrical care. “The amount of anxiety and the number of nightmares and sleepless nights caused by lawsuits is the worst,” says one retired ob-gyn who wishes to remain anonymous. He left his private practice after 35 years when he realized that he was working three months of the year solely to cover the cost of his $60,000 malpractice insurance premium.
“I’m not paid a penny more for high-risk cases,” says Laurie Green, a San Francisco ob-gyn. And “because of the cost of doing business and the threat of lawsuits,” she says, “we have a terrible time recruiting new doctors.”
The combined pressures surrounding obstetrical care continue to take their toll. The ACOG survey shows that as a result of the risk of malpractice, 17.1% of ob-gyns have decreased the amount of high-risk obstetric care they give, 8.9% are no longer practicing obstetrics at all, and 6.2% are decreasing the number of deliveries they perform.

Okay, so from your own source, ob/gyn are in a high risk occupation, along with surgeons, and your source says that this is why they are sued so often.
And they are sued because things went medically wrong.
Abortion doctors according to our resident quack, SoMG, aren’t doing anything remotely close to surgery so they shouldn’t be judged by the same standards. And they aren’t being sued, they’re having their licenses revoked and being charged with felonies…not because a child was born with a deformity, but because they used dirty instruments and forgot to wash their hands.

Gee Heather, maybe that’s because abortion is a women’s political issue. Protecting a woman’s right to choose is a political issue. Women’s health is a political issue.

These trucks drive around my college campus. No one seems to mind that there are at least three elementary schools right around the campus. Do kids under the age of 9 **need* to be exposed to those pictures? They are youg and innocent, and do not understand the issues surrounding pregnancy or abortion. These pictures could truamatize a child for life, and yet some PL’s dont seem to mind as long as their “message” gets across.
Or what about people who do not like gorey pictures or movies. They could go into a panic while driving and wreck their car (possibley killing someone or themselves).
I dont think it is right to involve children in a debate that is emotional and heated on both sides. They cant vote and therefore dont get a say so in state of government regulations/laws. Children under the age of 15 (in my opinion) should not be shown these kind of pictures. I mean hell under the age of 17 and you cant even see a “R” rated movie in America.
There is a time and a place for these type of pictures to be shown. And on city streets where the faint of heart or young children can see them is definitely not one of them. Show them at your PL rallies or meetings. I mean dont get me wrong, I am all for free speech, but not when it comes to something that could traumatize an innocent child.

Different state, different story. I am in Alabama. Sex in any shape or form is not brought up until 10th grade here. And even then they don’t go into detail. I don’t know what school is teaching an eleven year old to put a condom on a banana, but they taught us “abstinence only” at me school and I was 16 when Sex Ed was offered (you cant take it before 16, unless you have parental permission).
And I think it is wrong to use a child as a “political tool” for either side. I am pro choice and would never allow my children (under the age of 15) to know what one is or subject them to holding signs at a PC or PL rally. That is tasteless and trashy in my opinion.

No one should ever be forced to get a vaccination. A 14-year-old is not stupid. She should be able to say no if she wants to. However, she should also be able to say yes.

I know of one OB/GYN that was sued for saving a patient’s life. She had a condition called placenta acreta, the placena adhered to the uterine wall. The baby was delivered by C-section but the OB-Gyn had to do an emergency hysterectomy to save the woman’s life. The lawyer dropped the case when the OB-GYN asked what alternative he had and the lawyer couldn’t find one.
As you can see, many of the lawsuits against OB-GYNs are frivulous. People demand perfect babies and happy outcomes. The doctor is expected to prophesize every possible fetal anomoly and every potential problem. Is it true John Edwards made a fortune suing doctors for cerebral palsy babies despite the fact CP has been around since creation and no one is even certain what causes it?
Patricia, I wonder if CBR has ever had any problems with people driving them off the road. Last summer, we were driving through Montana and were almost run off several times by a trucker who disagreed with the pro-life stickers on our trailer. After a while, he resorted to throwing things at our windshield (bottles, a McDonalds cup, and some garbage).
We reported him to his company.

Those trucks would deliberately block traffic on my campus. They would just stop in the middle of a crowded, narrow street and sit there. This is a street that leads to the ambulance bay of the hospital. They had their display outside of one of the main classroom building areas, thats fine and all, free speech, okay, but actually being a hindrance in a busy urban area, especially if an ambulance needed to come through, is not okay.
Yeah, that OB/GYN profession is risky. Upon speaking with many medical professionals about it, every single one of them says, “high medical malpractice insurance. Many people are needed who are willing to put up with it.”
It really is sad. People can’t tell the difference between real incompitence or neglect and someone doing their best to treat their patients.
Part of it stems from a general greediness and how easy it is to make the quick money. Part of it in my opinion is how lawyers sell themselves, I even see TV commercials. “Did your doctor accidently mess up? I can give you compensation!”

You’re right. Its appalling greed. I know of no way to prenatally test for cerebral palsy, but insurance companies have shelled out millions to parents who have claimed it was a birth injury or result of faulty care. Its more likely to be the result of faulty prenatal wiring that no one can predict or prevent. I believe the British, correct me if I’m wrong, have a system where if you go to court and lose, you pay all expenses. Maybe this would be a good way to keep frivolous lawsuits in check.
Before we cry about the problems with insurance coverage and the “health care crisis”, we need to take a long hard look at our own greed.

Agreed that the US is lawsuit crazy. I worked with a British guy in Canada, and he said that many of the lawsuits we hear about would be laughed right out of the courtroom in England.
There could be grounds for suing an OBGYN – it’d depend on the case. The “ripped shirt” deal sounds like the man should have his suit dismissed with extreme prejudice or whatever the terminology is, all legal bills for all parties being payable by him.
The McDonald’s case has two sides to it. In the beginning the woman only wanted medical expenses paid. McDonald’s refused, the case went to court, and the woman was eventually awarded some millions of Dollars.

Concerning the McDonald’s case, I can’t agree they were responsible for her medical expenses. Being elderly, her skin was likely more prone to severe burn damage. She unfortunately spilled something hot on herself, something we’ve all done. I remember children in school who were scarred from severe burns they received as toddlers when they pulled something hot onto themselves. Tragic, but accidents happen.
Maybe this lady was simply careless, like all of us have been, and suffered an injury because of it. In cases like this, we have no one to blame but ourselves.
Unfortunately, nothing is our own stupid fault anymore.

A Whale of a Lawsuit.
The parents of a man found naked and dead on the back of a killer whale at SeaWorld Orlando are suing the marine park, alleging the dangerous orca was portrayed as a huggable stuffed toy, according to a lawyer representing the family.
Patricia and Michael Dukes of Columbia, S.C., filed suit September 10, 1999 in Orange County Circuit Court seeking several million dollars for pain and suffering at the loss of their only son, Daniel, 27, a drifter who drowned in July in a whale tank at the Florida theme park.
Attorney Patricia Sigman said SeaWorld is legally liable because it portrayed the killer whale as human loving.
After the naked corpse of Daniel Dukes was found in a tank with a killer whale at Florida’s SeaWorld, park officials determined that he had drowned after slipping past security and trying to swim with the whale.
Claiming that the park should warn visitors that the animal could kill people who enter the water — aside from referring to it as “killer” whale — just doesn’t hold water, does it?

The cases are good for cocktail parties and illustrate that our system is out of control. As you can see, anybody can sue anybody for nearly any reason. Lawyers are not policing themselves and, someday, this will backfire. But, enough of that, here are the cases:

I agree that she was responsible. She spilled it on herself. I’m not saying Mickey D’s should necessarily pay anything at all. My point was just that she didn’t ask for much in the beginning. As it worked out, the judge/jury felt that McDonald’s was in error for keeping the coffee as hot as it was, quite a bit hotter than is normal, to extend the amount of time it’s considered “good.”

A young woman sued a nightclub after she fell out of a bathroom window, knocking out two of her front teeth. She won $12,000 plus dental expenses. (She fell from the window as she was attempting to sneak into the club to avoid the $3.50 cover charge.

Cigar Insurance
A Charlotte, NC, man having purchased a case of very rare, very expensive cigars insured them against fire among other things. Within a month, having smoked his entire stockpile of cigars and without having made even his first premium payment on the policy, the man filed a claim against the insurance company.
In his claim, the man stated the cigars were lost “in a series of small fires”. The insurance company refused to pay, citing the obvious reason that the man had consumed the cigars in the normal fashion. The man sued…. and won.
In delivering the ruling the judge agreeing that the claim was frivolous, stated nevertheless that the man held a policy from the company in which it had warranted that the cigars were insurable and also guaranteed that it would insure against fire, without defining what it considered to be “unacceptable fire”, and was obligated to pay the claim.
Rather than endure a lengthy and costly appeal process the insurance company accepted the ruling and paid the man $15,000 for the rare cigars he lost in “the fires”.
After the man cashed the check, however, the insurance company had him arrested on 24 counts of arson. With his own insurance claim and testimony from the previous case being used against him, the man was convicted of intentionally burning his insured property and sentenced to 24 months in jail and a $24,000 fine.

This is a hoot. During one of our hometown NFL football games, a couple of newly acquainted married-to-someone else spectators in the stands decided to rendezvous in the bathroom. How romantic. Anyway, while they were in the throes of passion, a mother and her little girl walked in on them. So too did the police after the woman reported them. Anyway, they got slapped with some huge fines, over $3,000, and a court date. They also were named in a lawsuit filed by the mother for her daughter’s emotional trauma, which meant their indiscretion would become public record. I never heard what happened though I would bet an out of court settlement was arranged as quickly as possible!

A store owner in a crime ridden area was sued when a criminal was injured climbing through the skylight at 3am. The owner had rigged a devise to trap an illegal intruder, and did. Some local bleeding heart organization took the intruder’s case, stating that rigging the skylight posed a danger to law abiding citizens.
Law abiding citizens climb through skylights at 3 o’clock in the morning? Excuse me madame, but we usually walk through the front door during store hours.

Mary was kind and gave your story the benefit of the doubt, but I don’t. First, did you physically see this with your own eyes or just hear about it?
I actually know some of the people who drive these trucks, highly educated (including at least 1 PhD), intelligent and ethical all. There is a strategy to driving CBR trucks with quite a bit of organization, security, and care needed – yes, some for pro-aborts who go crazy when seeing the truth about abortion.
I know because my son helped with this effort three summers ago when interning for CBR. He was a senior in college but not allowed to drive. Too much skill and wisdom needed.
Those that claim to care about children show that they really don’t when they say that it’s fine to display inappropriate pictures in public just to further their agenda.
There’s something wrong with anyone that thinks it’s acceptable to traumatize children for any reason.

I can remember the case of one abortion clinic administrator who allowed her school age daughter to accompany her to the clinic and observe abortions. I recall no outrage on the part of PC people over this. I have seen celebrities bringing their children to PC rallies. Again, no outrage over this.

‘Truth’? Youve GOT to be kidding. That kind of hysterical melodramatic shock tactic is anything but the TRUTH. Are they showing the actual size of the embryo or fetus when abortions take place? No. Are the being honest about when abortions are typically performed? No. Are they being honest about fetal development? No. About 90% of abortions take place by 12 weeks with more than 60% taking place by 8 weeks. Are they admitting that? No. They are showing late term abortions, greatly enlarged and exaggerated and then trying to pretend they are ‘the truth about abortion’. Its another example of the total lack of integrity so typical of the antichoice side. If the truth suited the antichoice agenda they wouldnt HAVE to lie.

TX Red, Looking at the truck, it appears that the photo is of a later first trimester abortion. Of course, I would need to look more closely to see detail to age the fetus more definitely. Regardless, it is certainly not a photo of a “late term abortion” by any stretch of the imagination. Have you seen Bethany’s photos? She had a miscarriage when her baby was about 6 weeks gestation. She was able to photograph the remains. You might be suprised just how much detail can be seen at that stage of development.
Actually, the unborn child pictured on the bus is 11 weeks.
Iva, I’m sure even you can figure out proportionally how small the unborn baby is in the picture, by comparing the size of the hand holding him or her.

This is just as unacceptable to me as showing graphic pictures in public where children can see them.
Btw, why do you insist on lumping everyone in together? Do you agree with everything that every Pro-Life person does? Do you agree with bombing clinics and shooting doctors?

Where do I lump everyone together? I have heard PC people expressing their “concern” about children seeing graphic pictures, yet they are silent about an abortion clinic administrator that takes her school age daughter to see the real thing. I’ve heard people say children should not attend PL rallies and demonstrations, yet its perfectly fine for celebrities to bring their children to PC rallies. I was pointing out a very interesting double standard.
Do I agree with everything pro-life people do? I don’t consider people who bomb clinics and shoot doctors to be pro-life, I consider them sick fanatics who represent nothing but their own twisted philosphy. Just as I consider the KKK and other “Christian” white supremist groups as sick fanatics whose twisted philosphy in no way represents me as a white American and most cerainly does not represent Christianity in any way, shape or form.

Just why are the pictures inappropriate?
And it is too bad children have to see the truth about abortion. Given the choice, however, I’d rather a child see one than be one.
And you have the nerve to say you’re worried about “traumatizing children”? How disengenuous. Which is the real trauma, seeing a photo of someone chopped to pieces or being the one chopped to pieces?
