Unprecedented: Five Kansas Supreme Court justices recuse themselves in Kline case
Read my previous post here.
Only four days after former Kansas Attorney General Phill Kline filed a blistering motion asking that two Kansas Supreme Court justices recuse themselves from deciding whether to suspend his law license, the Supremes announced yesterday that FIVE of the seven would be doing so.
Their rationale, according to the The Topeka Capital-Journal:
The five justices voluntarily stepped aside, citing the Kansas Code of Judicial Conduct rule that requires recusal when a judge “previously presided as a judge over the matter in another court.”
Without ever mentioning Kline’s motion, the five stated it “would not be possible” for them to give Kline an unbiased trial, since they had ordered the very disciplinary hearing that resulted in Kline being brought before them.
Court spokesperson Ron Keefover acknowledged the mass exodus was “unprecedented.” Former Chief Justice Kay McFarland said it was “unheard of.”
Kline attorney Tom Condit proclaimed a victory but added in a statement the move only demonstrated the case was “irretrievably flawed.”
This is because the two left to decide Kline’s case are Sebelius appointees, and the five recusers will choose their own replacements from a lower court.
Kathleen Sebelius is the former pro-abortion governor of Kansas, now U.S. Health and Human Services Secretary. Sebelius repeatedly erected political and legal roadblocks to thwart AG Kline’s investigation of two late-abortion clinics for illegal abortions of children and fraudulent reporting to the state.
Kline’s investigation found that during a time when over 160 Kansas children 14 and younger had abortions in Kansas, late-term abortionist George Tiller and Comprehensive Health of Planned Parenthood each only reported one case of child sex abuse. This evidence, however, was squelched by orders from the Kansas Supreme Court led by Chief Justice Carol Beier (one of the recusers) and actions of former Attorneys General Paul Morrison and Stephen Six.
Furthermore, it was learned only last year that Sebelius’s Kansas Health Department shredded documents in 2005 that provided evidence that Planned Parenthood filed false reports to try to cover its tail after Kline launched his investigation.
On that point Condit concluded in his statement:
The recusing Justices, after reading Mr. Kline’s motion, suddenly discovered that they had previously complained about Mr. Kline’s behavior, and thus should not hear the appeal. This fact was known to them when the appeal was filed last fall – over six months ago….
The court has known its claimed reason for recusal for years and only acted four days after Mr. Kline’s motion was filed.
Who will judge the judges?
———
Psalm 82.
God presides in the great assembly;
he gives judgment among the “gods”
“How long will you defend the unjust
and show partiality to the wicked?
Defend the cause of the weak and fatherless;
maintain the rights of the poor and oppressed.
Rescue the weak and needy;
deliver them from the hand of the wicked.
“They know nothing, they understand nothing.
They walk about in darkness;
all the foundations of the earth are shaken.
“I said, ‘You are “gods”;
you are all sons of the Most High.’
But you will die like mere men;
you will fall like every other ruler.”
Rise up, O God, judge the earth,
for all the nations are your inheritance.

I think it would’ve saved the taxpayers quite a bit if they’d just tied Kline to a stake and lit him on fire the first go-around.

Corruption in Kansas is an understatement. So much for the heartland…
God bless and protect Phil Kline. He is a white martyr.

I think you meant Tiller, X.
Thank you Phil Kline for standing up for truth and justice!

It’s amazing what craziness ensues when corruption reaches to the highest levels of a government.

Praxedes,
You forgot your sarcasm glasses. ;)

Prax,
I was alluding to the fact that Kline’s professional persecution has been nothing but a witch-hunt in the midst of a kangaroo court.

They’ve been so zealous about late-term abortions performed on young girls that it makes me wonder if they’re trying to protect a powerful family or somesuch from embarrassment. It’s corrupt and bizarro to a ludicrous degree.

Mary Ann, that had been my thought to when this all started years ago. I expect the clinics under investigations had some really juicy skeletons in the preverbial closet that they threatened to expose if they didn’t get help making the mess go away. Regardless of the ‘sacrament’ of abortion, most people still get pretty steamed when they learn a 13 year old’s suspected abuse isn’t reported, so the level to which they fought this always struck me as conspiritorial.

If there is any one out there with a generous heart, please hear more about who is defending the Kline case; LIFE LEGAL DEFENSE http://www.lldf.org/ (and I am not ‘authorized,’ to endorse them, just a fan y’all) is the ones on the forefront in defending this case. PP has been scathingly audacious in their destruction of Phillip Kline.
Gunning to debar him is just one of the many attacks. They are hoping to destroy this man for essential witnessing on behalf of women, some of whom are no doubt sex-slaves, who have been forced into abortions, a nightmare following a nightmare, and no doubt are still suffering in silence because of the fear of their oppressors. The same oppressors who raped them sexually, raped them again with the paid tools of the abortionist, brutally murdering their little pre-born child.
Kline stands in a position of Christ between the “judges” and the “Mary Magdalene’s,” of Kansas and the world.
That being said a win in the Kline case would reveal not only the criminality of the destruction of evidence, but put the spotlight on what exactly they were trying to cover up–essentially aiding and abetting in cases of child prostitution, rape, statutory rape (all this was in the records shredded). Contact Dana Cody at LLD for more info, I got all this off of their appeal letter.
There is a reason PP holds fundraising events while their practices are under scrutinty–the true believers give in the glare of the spotlight to use the donations to brag to their pro-aboriton cronies about how they supported “a woman’s choice,” in their time of need. But this time, it has nothing to do with a “woman’s choice” this time, it has everything to do with two lives that have been ruined by the profiteers and rapists who hide their evil crimes behind feticide, and the expense of the unborn and underage women who have been cheated out of the American Dream of life, liberty, and the persuit of happyness, to an extent most couldn’t fathom. Again, these are the ones backing Kline.
LIFE LEGAL DEFENSE http://www.lldf.org/
Any amount–think about it and DONATE! This is the most crucial case the pro-life movement will see all year, and it could unravel the entire case for legalized abortion if the life-movement fuels it and supports it. Few have the courage Kline has.
