Gosnell and Castro cases expose inconsistency on right to life

gosnellcastroIn the state of Ohio, fetal homicide is against the law, and “[a]ll of Ohio’s homicide and assault statutes prohibit actions which kill or injure another person’s unborn child at any stage of pregnancy,” which is what Ariel Castro did not once, but five times. Therefore, after the women’s rescue and Castro’s arrest, babies who would otherwise be viewed as non-viable entities, legal to dispose of under the law, are now positioned to become the driving force behind a possible death sentence for Ariel Castro for “aggravated murder.”

Stanek weekend question: Thoughts on first-ever passage of personhood amendment?

Embarrassing CapitolMarch 22 was historic for the pro-life movement. Quoting Huffington Post:

North Dakota became the first state on Friday to pass a fetal personhood amendment, which grants legal personhood rights to embryos from the moment of fertilization. The state House of Representatives voted 57 to 35 to pass the amendment, after the Senate passed the same measure last month.

The measure will now appear on the November 2014 ballot [JLS note: governor did not need to sign], and voters will be able to accept or reject it. If it passes, it will amend North Dakota’s constitution to state that “the inalienable right to life of every human being at any stage of development must be recognized and protected.” The amendment would ban abortion in the state, without exceptions for rape, incest or life of the mother….

There was another first, most encouraging. According to LifeSiteNews.com:

  • In an attempt to further abortion worldwide, the United States and the European Union joined forces at the UN Commission on the Status of Women to ask for the deletion of “a reaffirmation that every human being has the inherent right to life, liberty and security of persons.”
  • Authorities in Minnesota have charged a man with two counts of murder for killing his wife and his unborn child:

    The Dakota County attorney’s office charged Roger Earl Holland, 36, with two counts of second-degree intentional murder – one count in his wife’s death and one in her unborn child’s death. Bail was set at $1 million, or $750,000 with conditions….

    Holland called 911 last Thursday to report finding his wife, Margorie Ann Holland, in cardiac arrest at the foot of a staircase in their Apple Valley apartment, prosecutor James Backstrom said in a news release. Margorie Holland, who was nearly four months pregnant, and her unborn child died at a hospital later that morning.

Stanek weekend question I: If a fetus has no right to life, how can a dad be charged with murder for attempted abortion?

A tragic story about a terrible man from thebraiser.com, October 18:

Yesterday, Joshua Woodward (pictured right), a former New York City restaurateur and partner of chef Govind Armstrong, was arraigned on charges of attempted murder after he secretly administered an abortion drug to his pregnant girlfriend, who soon miscarried their 13-week-old fetus.

Woodward, who opened Table 8 in the East Village with Armstrong back in 2008, pled not guilty, though he has a really bad case against him. As the NYDN recaps the 2009 case:
