Planned Parenthood subpoenas Phill Kline for 6th time
I wrote in my column yesterday that part of Planned Parenthood of KS/George Tiller’s strategy to beat Phill Kline’s rap against them is to file nuisance lawsuits and subpoenas to persecute their prosecutor.
The ink is barely dry on the KS Supreme Court’s latest decision against PP and in favor of Kline, and the Associated Press is reporting PP plans to file its SIXTH subpoena against Kline to go over the same issue: the working copies of records he has. The goal is, obviously, to trip Kline up and accuse him of perjury. From the AP article:
[PP attorney Pedro] Irigonegaray said he wants to force Kline to testify and to produce a detailed accounting of the records in his possession and who’s had access to them.
I repeat, if the court allows this, it would be the SIXTH interrogration of Kline by PP on the SAME ISSUE. The premise of the subpoena is PP’s concern Kline will take the records with him when he leaves office, which is absurd:
Irigonegaray acknowledged he’s received no complaint or notice that Kline intends to take materials with him when he leaves office.
I understand the subpoena cites no case law or statute. It has been filed without legal precedent. A hearing is scheduled for December 18 before the very same judge, Stephen Tatum – who has yet to schedule a hearing to decide whether Kline has enough evidence against PP to go to trial!

Not that I am any expert on this, but:
1) Since Kline is no longer a prosecutor but is now a mere ordinary citizen, it seems to me that he no longer has the right to retain the records in question. Not that they necessarily should go back to PP, but at the very least they should be returned to the offices of the prosecutor who replaced him or who has jurisdiction in the case. Aside from a professional ethics issue of taking files from his office, retaining them violates the privacy of the patients detailed therein.
2) Filing lots of harassing lawsuits is a perfectly acceptable tactic for antis, but when pro-choicers do it you cry foul? Gotta love the double standard that is seemingly universal among conservatives.
Oops, forgot Kline hadn’t left office yet. Have to wait another few weeks before we can sing “Ding dong the witch is dead!”
My statement stands, though. If those records leave Kline’s office, Kline should be disbarred, if not convicted.

Subpoenas never cite case law or statute. You just file them. If the witness objections, they file a motion, and then the party issuing the subpoena has to give some authority for their position.
Ray: Anyone would be ludicrous to think a prosecutor would take records of a case with him/her. It doesn’t happen, and Kline has never displayed any professionalism whatsoever that would leave anyone to worry he would.
Hal: You don’t know what you’re talking about. I’m in touch with legal experts on the KS case.
Jill, I do know what I’m talking about. I’m not saying Planned Parenthood is right or wrong. I can imagine the subpoena power can be abused. Maybe it is in this case. I’m just saying subpoenas themselves do not cite case law or statutes. You just send them out.

Just remember hal, if they kill innocent babies, they have no respect for the law or civility either. Remember they do not care about the records. They care about the evidence. There is evidence of wrongdoing in them.
These are wicked people. They are covering rape and we all know it.
Thank God for Phill Kline. He has faced absurd persecution for standing up for the law and for the unborn.

I personally have experienced this prosecution myself. And leading the way are so-called “Catholics” who often are especially angry towards those who demonstrate any sort of faithfulness towards Catholic values – and thus prick their consciences. They can be quite nasty.
There is no honor, no decency, no truth in those who kill babies, or who facilitate the killing of babies. You can easily see that by the rancid, venomous attacks on this decent, honest man by the rabid proaborts who come to this prolife forum to try to make everyone else as miserable as they are.
Let’s face it: the abortionist movement and the abortion industry are essentially an organized crime racket which specializes in killing millions of children.
They are people who have severe moral and spiritual weaknesses and they will continue to kill until we find a way to stop them. I have always found it distressing the cold blooded and ruthless nature of that movement. I hate the fact that we have to fight this fight. We shouldn’t have to stop child killing; it simply shouldn’t exist. This is the reality we face.
As long as the weaknesses of human nature persist, they will throw everything at us as we try to end this violence. I think Phill Kline already knows that.
Kline is out of office in Jan, his vendetta against PP ends a week or two later. Goodbye, Phill.
the records don’t contain names, I think all they contain is the age and the gestation (how far along) the girl/woman was.
Prayers for Mr. Kline. God Bless him for his work exposing this horrendously evil organization.
There is no other way of putting it…. Dr Tiller is a baby killer. I’ll never know how people like him sleep at night.

Speaking only for myself, I’m as happy as a clam at high tide. Not miserable at all. Life is sweet, and I enjoy every day.
Hopefully some of those records are from people who Kline will represent in his new position representing Johnson County, then he can continue his persecution, I mean prosecution of the baby killers whose records he has.

I wholeheartedly agree…we have several of those in our parish. And these people are either the ones running the parish ministries, teaching the CCD’s or just complain a lot to the Parish priest.

As of right now this thread is only 20 comments long, so it should be easy. When you made your comment, there were only 10, most of which were pro-Kline. I’m interested in learning where someone left ‘rancid and venomous attacks’ against Phil Kline in this thread. Thanks.

Well, Hal, all I can say is you make it look “effortless”, then.
I live in Johnson County and most everybody here is saying “good riddance” to Phil Kline.
The problem with Kline is that he goofs off way too much, among other things. His personal vendattas take priority with him, over doing his job . Pro-lifers and pro-choicers both know the guy’s next-to-worthless as a “public servant.”
People are sick and tired of paying this guy a lot of money while he does one of the crappiest jobs imaginable.
KCTV channel 5 uncovered quite a bit about Kline, some of which had long been rumored.

Danielle, I was as serious as a heart attack, and I know it is true. Anger and frustration? Sometimes, yes, but not when I wrote that. It’s the cold, hard, plain truth as I see it.
But then, I take a very dim view of the practice of electively killing unborn babies, so you may not be able to see my viewpoint.
How surprising…. all the posts making nasty personal attacks on Phil Kline are being done by rabid proaborts…. what a shock!
He’s the most courageous, most self-sacrificing public servant in American politics in a long time.

There are some good pro-life politicians, but Kline has proven himself to be a very poor choice, regardless of how one feels about abortion.

Seriously? that’s all you need to know? He could be a liar, thief, or adulterer, but you’d support him because of his dedication to the unborn? I’ve heard of one issue voters, but that’s pretty extreme.
That’s the thing, Hal, I have many years of experience working with other prolife activists, and those who help us. And in all that time, I’ve never met a single strongly prolife person that was a theif, a liar, or an adulterer. There’s just something about being a dedicated prolifer that won’t allow them to do that, ever.
Doyle, using words like “never” or “ever” may be dangerous; I know people who are pro-life that have fallen. The point is they get back up.
Hal, am I to conclude that you are waiting for results that prove veracity, trustworthyness and fidelity before you can make up your mind to support an idea that many imperfect people support?
The bottom-line remains that without life nothing is possible. Who am I that I can take the life of the unborn? Lets everyone take this question a step further. If I can abbreviate life in the womb, why not when my children get on my nerves, or when I feel like I just don’t want to live any longer.
I did not determine when I or anyone else for that matter came into this world; how can I claim such awesom authority as to whom, by what means, and at what time departures are effected?
