Planned Parenthood deathscort convicted
I wrote in December 2011 about Planned Parenthood Ann Arbor deathscort Bernie Klein, well known to Michigan pro-lifers as your basic jerk.
But on September 30, Klein went too far and was charged with assaulting a sidewalk counselor.
After pleading down to the misdemeanor charge of “jostling,” Klein was convicted two weeks ago and slapped with a $250 fine.
Meanwhile, Klein continues to menace pro-lifers. This video was shot on February 25, 2012, after the assault and battery charges were filed and before Klein was convicted. If nothing else the man lacks common sense and/or self control.
Wearing the badge, “PLANNED PARENTHOOD STAFF,” Bernie is shown not only harassing pro-lifers but sideswiping the camera person.

In 2009 Klein was arrested by the feds as part of an assisted suicide ring.
If anyone could fall under the category of “domestic terrorist,” it would be Bernie Klein.
But don’t expect Attorney General Eric Holder to investigate him any time soon. Holder is himself too busy harassing pro-lifers in his own unique way.

Bernie’s little song has me worried for his sanity. And I don’t think he was correct in what he’s saying about where the pro-lifers can stand. This is what I found on the 40 Days for Life website he mentions:
· During late night hours feel free to pray anywhere in or outside the circle drive but never cross the lines at either Planned Parenthood entrance. Many prayer warriors pray in and around the circle.
· During open hours, hold up signs and/or literature to attempt to give to clients (see Sidewalk Counseling document) if you feel so moved. Standing by the No Outlet sign right at the car entrance to Planned Parenthood is a good place to reach cars as they are entering and also to talk to clients as they walk from the parking lot to the clinic. We have documentation to support our presence on the curbs of the circle.
Well, Eric Holder sure has his priorities straight.

Correct me if I’m wrong, but PP is a BUSINESS… a business is PUBLIC property, not “private”. If businesses had “private property” signs up..they wouldn’t GET much business…right?
And now I want to know what his personal experience with abortion is too!!

Pamela, businesses are private property (excepting governmental businesses). They can ask anyone to leave at any time, bar enterance to anyone at any time, and have the legal right to expell tresspassers with necessary force. From the corner grocer to a doctor’s office to PP, they are all private property that is open to the general public during business hours at the good will of the property’s owner.
The easement, sidewalk, or other area between the border of the property and the public street, however, is public land owned by the city, county, or state and is open to public access within the bounds of applicable governmental law.
And many stores, btw, have a small sign posted somewhere (for liability reasons) that states ‘private property’ and/or ‘we reserve the right to refuse business’. Even a lot of Walmarts (how more public can you get than a 24 hour supercenter?) have signs stating ‘this store is private property’.

Jespren, you’re correct, but the business must have a valid reason for barring. Though private, a business is granted an implicit charter to operate publically, that is, it must accomodate all comers short of health code (no shoes in a restaurant) or harm (swinging a knife) or illegal (public intoxication or drugs). Even rudeness alone to a cashier isn’t sufficient for the proprieter to expel a person, but s/he could call the police if it becomes threatening.
Based on the implicit public charter, a business could not claim private property and expel someone based on gender, race, or a message on a t-shirt (eg “Queer and proud” or “Confederate Rebel and proud”. Disruption to customers is sometimes used as a reason for barring someone, but that can be exceedingly subjective, so a court may have to determine if it would be disruptive to a reasonable person. A court’s definition of a “reasonable person” is going to be subjective, too, as more and more judges and lawyers come out of rather left-wing law schools (understatement alert).

Don’t I know that left-wing law school stuff… It’s so disheartening. As a 1L, I have 2 more years of this BS to look forward to. It’s so taxing. *sigh* What’s worse…I go to a CATHOLIC law school. It’s still pretty bad. I’d hate to have gone to a secular school. It’d be even more unbearable. I fear for the future of the legal profession based on the people with whom I attend school. We’re in for a hell of a ride.
Makes me want to go into a PP (or the local butcher shop in my neck of the woods) for a pap appointment wearing a Pro-Life tee. I’d do it, if it wouldn’t net them any money. :(

Xalisae, if you do stop into PP or other abortion clinic with a pro-life tee, I’d love to hear the reaction. Lyssie may have to clarify the details, but they shouldn’t be able to force you out just for your message. Of course PP wouldn’t consider you a reasonable person if you’re pro-life.
Another pathetic old would-be white knight, tilting at the windmills of religion and pro-life. I forget what made Don Quixote snap, but I think the guesses often made are right. He must have been involved in an abortion or two and wants to justify it to himself.
Xalisae: From what I know about property (one of my least favorite courses, BLEH!), Eric is basically right. In exchange for opening a business to the public, the government requires that that business allow everyone within reason to use its services. The premise is that since you opened for the public, and the “disruption” that someone may or may not cause by, say, wearing a pro-life Tshirt in a PP, is only limited and temporary, then the right of exclusion is limited. The government basically says “you invited it” by opening to the public. The only way that you could exclude on a legal basis is if the gov’t allowed a MATERIAL interference with your occupation or use. The government would be hard-pressed to find such a material interference when it comes to a pro-life Tshirt. However, with the state of the legal professionals graduating these days (rabidly pro-abortion), you never know what a judge might determine.
So frustrating.
My Students for Life group has had run ins with Mr. Klein before. We were there just a week after this incident and have seen him several times this year. His most common joke is the Spaghetti Man and telling us to have ‘safe sex.’ He’s notorious, apparently, but we’ve never backed down… I think he’s afraid of the 20+ of us!

I plead guilty because I did “goose” the most intrusive and obnoxious protester we`ve ever had in my 22+ yrs as an escort and by doing so I accomplished my two objectives… keep him (motortmouth Paul) out of court where he would have tried to use his appearance to attack PP and second, to have NO restrictions put on my escorting. Mission accomplished.
So “motormouth” and myself tangle twice weekly in the same location…business as usual. He yells at the women from the moment they leave their cars til the front door closes behind them….. same for women leaving the clinic. One client expressed that she felt “verbally raped” by him. So I remind him everytime he verbally rapes another women. Oh, he`s such fun to work with..lol But hey, he keeps me young..gets the juices flowing. In a few days I`l be 78 yrs and 10 months old….of course to you people I`ll be 79 yrs and 7 months old… that life at conception nonsense don`t ya know.
And no Jorden, I`m not afraid of your 20+… you generally have the sense to obey the rules so I don`t need to do anything. But that`s just soooo cute that you think you scare me. Right after they ask how long it can be until their girl can have sex again, because it’s all about THEM and how long they’ll have to wait before they can use their girls again. Poor dears.
Lrning: What you don`t believe your bible that says life begins for a human being when they first breathe?? Also the medical definiton of “fetus” says it becomes a fetus after 8 weeks in the embryonic stage and remains a fetus until it is born… then when it takes a breath it`s a human being.

Incorrect. The Bible says that when God creates a new type of being in his image out of mud, it becomes living when he breathes air into its nostrils. That doesn’t prove anything about fetuses or embryos (which are really just less mature humans that breathe in a different way). It should also be noted that babies don’t begin breathing through their lungs until several minutes after birth (or even longer if the cord cutting is delayed, as is sometimes done now).
